CERTIFIED PRE-OWNED CASHBACK REBATE

Terms and conditions

1. Products, Participating Retailers, Period and Participants
1.1. This program is a Canon Canada Inc. (“Canon”) program and only available on pre-owned products as specified in Schedule 1 (“Pre-Owned Products”) certified through Canon’s Pre-Owned Program.  A participant may then purchase products listed in Schedule 3 (the “Products”) within Canada from one of our participating retailers as set out in Schedule 2 (“Participating Retailers”) for cashback until such time as Canon decides to end the program (the “Period”). All other products and retailers are excluded. Some Products may be sold as a camera only or part of a bundle. Purchases must be genuine purchases for cash or its equivalent. Only Products sold by Participating Retailers are eligible for this program. Some Participating Retailers may operate marketplaces that allow other sellers to sell their products. Products purchased on these marketplaces are not eligible for this program. In addition, Products purchased through an enterprise commercial sales program are ineligible for this program.  Any attempt to gain participation in this program without satisfying the requirements mentioned above shall be deemed invalid as determined by Canon in its sole discretion.
1.2. All Participants must be aged 18 or over and must be resident in Canada and must be an eligible Certified Pre-Owned Program participant (“Participant”). An eligible Certified Pre-Owned Program participant is an individual who has had their gear evaluated and rated by Canon under the Certified Pre-Owned Program.
1.3. All Participants are deemed to have agreed to be bound by these terms and conditions.
1.4. All Products must be new and genuine Canon products. Purchases of second-hand, refurbished, or reconditioned products, or products that are counterfeit or infringe the intellectual property rights of the Canon group of companies in any way (for example, including but not limited to parallel or “grey” products) will not qualify under this program.

2. How to Participate
2.1. To enter the cashback program, the Participant must purchase a Product or Products from a Participating Retailer during the Period within Canada AND submit a valid claim online.
2.2. Claims must be submitted by fully and correctly completing (including specifying a valid product serial number that is a readable scan or a clear photograph <in colour> of the original barcode.) a claim form online, at www.canoncreatorlab.ca/offers for a Product purchased within Canada. Participants will need to scan, upload and attach to the online claim form a copy of their receipt, or order confirmation for internet purchases. Participants will then receive an email confirming that their claim has been received. If you do not receive a confirmation email within 24 hours of processing your claim or do not have access to a computer, please contact our Claim Hotline on 1-800-OK-CANON
2.3. The Products are subject to availability while stocks last. Canon will not be liable for the failure of retailers to fulfill orders of Products during the Period.
2.4. Canon will not process any claims received after 30 days of purchase. Canon will not process claims which are in its opinion incomplete or illegible. Canon will not be responsible for claims delayed or not successfully received.

3. Cashback
3.1. Participants will receive Cashback as set out in Schedule 1 in the amounts shown for purchases of Products.
3.2. Upon receipt and verification of the claim, Canon will arrange for a direct eTransfer transfer payment to the Participant’s bank account. No alternative arrangement will be entered into and no cash or cheque will be provided.
3.3. Canon will endeavor to transfer via eTransfer within 4-6 weeks of receipt of a complete and valid claim.
3.4. Only one eTransfer payment will be issued per valid claim.
3.5. Canon Canada Inc only accepts claims with banks that have been underwritten by the Canadian Deposit Insurance Corporation. To confirm that your bank is one of them, visit: https://www.cdic.ca/your-coverage/list-of-member-institutions/.

4. The Promoter
4.1. The promoter is Canon with its registered office address at 8000 Mississauga Road, Brampton, ON L6Y 5Z7.

5. Disclaimers
5.1. To the fullest extent permitted by law, Canon shall not be liable for any loss, damage, or injury of any nature howsoever caused, sustained by any Participant under this program. However, nothing in these rules shall have the effect of excluding or restricting Canon’s liability for personal injury or death caused by the proven negligence of Canon’s employees or agents.
5.2. In exceptional circumstances, Canon may void, amend, and/or change this program at any time without incurring any liability whatsoever provided that such changes are necessary and can be justified by objective reasons.
5.3. Canon reserves the right to audit any claims to ensure compliance with these terms and conditions and to request additional information and supporting documents. Canon reserves the right to exclude claims and/or Participants if it suspects that the program is being abused in any way. Canon’s decisions in relation to the program are final and no correspondence will be entered into.
5.4. If any part of these conditions is found by a court of competent jurisdiction or other competent authority to be invalid, unlawful or unenforceable, then such part shall be severed from the remainder of these conditions, which shall continue to be valid to the fullest extent permitted by law.
5.5. Canon, its associated companies, affiliates, suppliers, advertising/program agencies, and any other entity or entities involved in the development, production, administration or fulfillment of this program, and each of their respective agents, employees, directors, successors, and assigns (collectively, the “Released Parties”) will not be liable for: (i) any failure of the Canon website or any other site during this program; (ii) any malfunctions or other problems of any nature whatsoever, including, without limitation, those relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (iii) the failure of any Product registration, opt-in and/or other information to be received, captured or recorded for any reason whatsoever, including, but not limited to, technical problems or traffic congestion on the internet or at any website; (iv) any injury or damage to a Participant’s or any other person’s computer or other device related to or resulting from participating in this Program; and/or (v) any combination of the above.
5.6. By participating in this program, each Participant hereby: (i) confirms compliance with these terms; (ii) releases the Released Parties from any and all liability in connection with this program and his/her participation therein; and (iii) agrees to the publication, reproduction and/or other use of his/her name, statements about the program and/or photograph or other likenesses without further notice or compensation, in any publicity or advertisement carried out by or on behalf of Canon in any manner whatsoever, including print, broadcast or the internet.

6. Data
6.1. By participating in this program, each Participant expressly consents to Canon, its agents and/or representatives, storing, sharing, and using any personal and other information submitted only for the purpose of administering the program and in accordance with Canon’s privacy policy (available at the link below). This section does not limit any other consent(s) that an individual may provide Canon or others in relation to the collection, use and/or disclosure of their personal information. Canon is the Data Controller in respect of any personal data supplied by Participants. Any personal data submitted to Canon will be processed by (a) Canon and its third-party supplier Benamic Ltd, IDA Business and Technology Park, Ring Road, Kilkenny, Ireland, for the purpose of administering this program, and, if applicable (b) by Canon and its associated companies for marketing purposes in cases where Participants have opted-in to receive marketing communication from Canon. 6.2. If Participants do not wish for their contact information to be used for marketing purposes or to enable Canon to contact them in the future regarding similar programs, they should NOT check the relevant “opt-in” box when completing the claim form.

7. Law and Jurisdiction
This program shall be interpreted and enforced in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein. The forum for any disputes relating to this program shall be the Province of Ontario and you agree to attorn to the courts in the Province of Ontario and they agree that all legal proceedings in respect of this program shall be commenced and maintained only in the courts of the said province.
